Terms of Service

1. Agreement to Terms

By accessing or using the BarGen API service ("Service") operated by InstaSoft Informatikai Zrt. ("Company", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

The BarGen API is a REST API service that generates barcode and QR code images. The Service provides:

• Barcode generation in multiple formats (SVG, PNG, PDF, EPS)
• Support for various barcode types (QR, EAN, UPC, Code128, etc.)
• API key-based authentication
• Usage tracking and analytics

4. Account Registration

To use the Service, you must:

• Be at least 18 years old or have legal authority to enter into contracts
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use

You are responsible for all activities that occur under your account.

5. Subscription Plans and Pricing

5.1 Available Plans

• Free: 1,000 API calls per month, SVG format only
• Pro: Unlimited API calls, all formats, priority support
• Enterprise: Unlimited API calls, all formats, dedicated support, SLA

5.2 Billing

• Paid plans are billed monthly in advance
• Prices are in EUR and include applicable VAT
• Payment is processed securely via Stripe

5.3 Cancellation

• You may cancel your subscription at any time
• Access continues until the end of the current billing period
• No refunds for partial months

6. Acceptable Use

You agree NOT to use the Service to:

• Generate barcodes for illegal purposes
• Create counterfeit product barcodes
• Attempt to circumvent rate limits or usage restrictions
• Share API keys with unauthorized third parties
• Reverse engineer or attempt to extract source code
• Overload or disrupt the Service infrastructure
• Violate any applicable laws or regulations

7. API Usage Limits

• Free plan: 1,000 requests per month
• Rate limiting: 100 requests per minute per API key
• Maximum batch size: 100 barcodes per request
• Exceeding limits may result in temporary suspension

8. Intellectual Property

8.1 Our Property

The Service, including its code, design, and documentation, is owned by InstaSoft Informatikai Zrt. and protected by intellectual property laws.

8.2 Your Content

You retain ownership of the data you encode in barcodes. You grant us a limited license to process this data solely to provide the Service.

8.3 Generated Barcodes

You may use barcodes generated through the Service for any lawful purpose, including commercial use.

9. Service Availability

• We aim for 99.9% uptime but do not guarantee uninterrupted service
• Scheduled maintenance will be announced in advance when possible
• We reserve the right to modify or discontinue the Service with notice

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "AS IS" without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability shall not exceed the fees paid in the last 12 months
• We are not responsible for third-party services (Stripe, etc.)

11. Indemnification

You agree to indemnify and hold harmless InstaSoft Informatikai Zrt. from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Your payment method fails repeatedly
• Required by law

Upon termination, your right to use the Service ceases immediately.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of Hungary. Any disputes shall be resolved in the courts of Budapest, Hungary.

15. Dispute Resolution

Before initiating legal proceedings, you agree to attempt to resolve disputes through good-faith negotiation by contacting us at support@bargen.pro.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.
